DUI / DWI

Driving Under the Influence (DUI/DWI) is a serious offense with several potential consequences. Punishment includes fines, court costs, license suspension and potentially jail time. It is an enhanceable offense, meaning with each subsequent offense, the penalties are harsher. At the moment, in Kentucky, the Courts are allowed to look back ten (10) years to determine whether or not your current offense is a first or subsequent offense.

DUI / DWI Penalties (KRS 189A.010(5)(a) - (d)) :

  • First Offense (misdemeanor) - $200 - $500 fine, DUI Service Fee ($375), Court Costs, 48 hours to 30 days in jail, Ignition Interlock Device (IID), License suspension of 30 - 120 days, Alcohol Driver Education (ADE)

  • Second Offense (misdemeanor)- $350 - $500, DUI Service Fee ($375), Court Costs, 7 days to 6 months in jail, Ignition Interlock Device (IID), License suspension of 12 - 18 months, Alcohol Driver Education (ADE)

  • Third Offense  (misdemeanor) - $500 - $1000, DUI Service Fee ($375), Court Costs, 30 days to 12 months in jail, Ignition Interlock Device (IID), License suspension of 24 - 36 months, Alcohol Driver Education (ADE)

  • Fourth Offense (felony) - DUI Service Fee ($375), Court Costs, 1 - 5 years in jail, Ignition Interlock Device (IID), License suspension of 5 years, Alcohol Driver Education (ADE)
